The terms governing the sale of our website creation services.

Purpose

These General Terms of Sale (GTS) govern the contractual relationship between Funeraco and its clients for the provision of website creation, hosting, and maintenance services for independent funeral homes.

Services

Funeraco provides website design and development, hosting, monthly maintenance, local SEO, and process automation services. The specific details of each service are defined in the quote accepted by the client.

Pricing

Service prices are indicated in euros, both before and including taxes. Prices are those in effect at the time of order. Funeraco reserves the right to modify its prices at any time, it being understood that services will be invoiced at the rate in effect at the time of order validation.

Payment

Payment is made by automatic monthly direct debit or bank transfer. A 30% deposit is required upon ordering website creation services. The balance is invoiced upon delivery of the website. Maintenance fees are invoiced monthly.

Duration

The maintenance contract is concluded for an initial period of 12 months, tacitly renewable for periods of 12 months. The website creation service is a one-time engagement that concludes upon delivery and client validation.

Termination

Either party may terminate the maintenance contract with 30 days written notice before the end of the current period. Upon termination, the client retains ownership of their content. Amounts already paid remain the property of Funeraco.

Liability

Funeraco's liability is limited to the total amount paid by the client in the last 12 months. Funeraco shall not be held liable for indirect damages, data loss, or loss of profit.

Personal Data

Personal data collected in the context of the business relationship is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). The client has the right to access, rectify, and delete their data.

Applicable Law

These GTS are governed by French law. Any dispute relating to their interpretation or execution shall be under the exclusive jurisdiction of the courts of Bordeaux, following an attempt at amicable resolution.
